Terms and Conditions

1.Definitions

'Photographer' refers to FZahra Photographer.
'Client' refers to the individual booking a session.
'Session' refers to the portrait photography session agreed upon.

2.Booking & Payments

- A session is considered confirmed once the non-refundable session fee/deposit has been paid.
- The remaining balance must be paid before or on the day of the session.
- Prices may change at any time, but confirmed bookings retain their agreed price.

3.Cancellation & Redescheduling (by Client)

- The session fee is non-refundable
- A session may be rescheduled once, provided the client notifies the photographer at least 48 hours in advance. Additional rescheduling may require a new session fee.
- Failure to attend the session (no-show) results in full loss of the session fee.

4.Cancellation by Photographer

If the photographer must cancel the session due to illness, emergency, or unforeseen circumstances, the client will be offered:
- a full refund of the session fee, OR
- a rescheduled session
at the client's choice.

5.Force Majeure & Technical Failure

In case of:
- force majeure
- equipement malfunction
- technical failure
- data corruption
- loss of damage of images before delivery
- unforeseeable circumstances beyond the photographer's reasonable control
the photographer cannot be held liable.

In such cases, the photographer's responsibility is limited to:
- rescheduling the session, OR
- refunding the session fee
No further compensation will be provided.

6.Photographer Liability

The photographer is not liable for:
- loss of images after delivery
- images not downloaded or backed up by the client
- delays caused by technical issues outside the photographer's control
- dissatisfaction based on artistic style, posing, or subjective preference

Clients book the photographer with full awareness of her stylistic approach, portfolio, and editing style.

7.Delivery & Backup

- Edited images will be delivered digitally within the timeline announced at the session.
- RAW images are never provided, as they are part of the photographer's intellectual property.
- RAW images are stored for up to 3 months, edited images for up to 12 months. Files may also be deleted earlier without notice. The photographer cannot be held liable for the loss or unavailability of images before or after the retention period.
- The client is responsible for downloading and securely storing their images.

8.Artwork, Editing & Retouching

- All images are edited in the photographer's style.
- Additional retouching beyond the standard edit may incur an additional fee.
- The photographer retain full discretion regarding artistic decisions, including selection, editing, cropping and style.
- No unedited or partially edited files will be delivered. This includes RAW files, unedited JPEG's, or unfinished images.

9.Copyright & Intellectual Property

All photographs remain the copyright of the photographer under Belgian and EU copyright law.

Clients receive a personal-use license, permitting them to:
- download
- store
- print
- share the delivered images privately or on social media
This license is non-transferable and does not grant commercial rights.

Clients are not allowed to:
- edit or alter the images
- apply filters to the images
- sell the images
- submit the images to contests
- use images for commercial or promotional purposes unless explicit written permission is granted.

10.Image Use & Model Release

Images will only be used for:
- portfolio
- website
- social media
- exhibitions
- advertising

if the client completes and signs the 'Portrait Privacy & Image Release Form' indicating consent.
Without this signed form, no images will be published.

Clients may withdraw consent at any time, but previously published images cannot be removed retroactively from printed materials, exhibitions, website or social media posts.

11.Client Conduct

- Clients must arrive on time, late arrivals may shorten the session duration.
- The photographer reserves the right to terminate the session if the client's behaviour is unsafe or inappropriate.
- No alcohol or drugs are permitted during the session.

12.Gift Vouchers

- Gift vouchers are non-refundable.
- They must be used before the expiry date indicated at purchase.
- They cannot be exchanged by cash.

13.Governing Law

These Terms & Conditions are governed by Belgian law.
Any disputes will be handled by the competent courts of Belgium.
